Background

Keller Rohrback L.L.P. partner, Derek W. Loeser, was appointed to serve as Co-Lead Counsel in this ground-breaking privacy litigation.  Plaintiffs’ complaint alleged that Facebook broke the law when it enabled third parties—such as the political consulting firm Cambridge Analytica—to access U.S.-based Facebook users’ personal content and information without their knowledge or consent, beginning in 2007. Plaintiffs also alleged that Facebook failed to properly protect users’ content and information from misuse or unauthorized access by third parties, which further violated users’ privacy.

In August 2022, the parties notified the Court of a settlement in principle. The Court granted final approval of the settlement on October 10, 2023. On February 13, 2025, the U.S. Court of Appeals for the Ninth Circuit affirmed the District Court’s decision. The landmark $725 million settlement is the largest recovery ever secured in a data privacy class action as well as the largest amount Facebook has ever paid to resolve a private class action. The settlement became effective as of May 22, 2025.
